Privacy Statement MY-LEX B.V.

MY-LEX B.V. and all its affiliated companies (hereinafter referred to as 'MY-LEX', 'we', 'us' or 'our') take the careful handling of your (hereinafter referred toas 'you' or 'your') personal data very seriously. Personal data is therefore treated and secured with the utmost care. In doing so, MY-LEX complies in all cases with the applicable laws and regulations regarding data protection.

We believe it is important to inform you, by means of this privacy statement, about what personal data we process and how and why we do so. Please read this privacy statement before using the MY-LEX products (hereinafter referred to as 'Products') or website. By using our Products and/or website, you agree to this privacy statement.

What is personal data?

Personal data is any information that can be used to identify or make identifiable a natural person (the data subject). The term 'process' means, among other things: collecting, recording, organising, storing, updating, modifying, and retrieving personal data.

What personal data do we process about you?

In most cases, we obtain your personal data from you, for example when you create a user account for one of our Products and then use our Products, when you visit our office or website, fill in a form on our website, give us your business card, or from information we obtain during (telephone) conversations or email contact with you. However, it is also possible that we obtain your personal data in other ways. Below, we explain in more detail in which situations we process certain personal data about you.

Information you provide directly to us

We collect information directly from you when you use our Products or website, call us, register for our events, contact us in any other way, or provide us with information directly in any other manner. The actual personal data we process in this case therefore depends on the personal data you provide directly to us.

Information we collect when you use our Products

We (and any third parties processing personal data on our behalf) use certain tools to collect information about you when you use our Products, subject to the terms of this privacy statement and applicable data protection laws and regulations. The types of information we may collect include:

  • the pages of the Products you view;
  • information about how you use our Products;
  • information about your device's operating system;
  • your username and password for using our Products;
  • search terms and other content you enter when using the Products;
  • information about the type of browser you use to use our Products;

  • your device ID; and
  • the hyperlinks you have clicked on.

Information we collect when you visit our website

We (and any third parties processing personal data on our behalf) use cookies and other tools to collect information about you when you use our website, subject to the terms of this privacy statement and our cookie statement and applicable data protection laws and regulations. The types of information we may collect include:

  • the pages of the website you view;
  • information you enter when using the website;
  • informationabout the type of browser you use to access our website;
  • the websites you visited before arriving at our website;
  • your IP address;
  • your device ID; and
  • the hyperlinks you clicked on.

Information we collect from other sources

We may also receive personal data about you from other sources. This may include information from commercially available sources, such as public databases and data aggregators, and information from third parties. The types of personal data we may collect from such sources include your:

  • address;
  • age or date of birth; and
  • publicly available information, such as user-generated content, blogs and posts.

All personal data we collect about you may be combined to improve our communications and marketing activities towards you and to further develop our Products and website.

Why do we process personal data?

In all the relationships we enter into and for the use of our Products and our website, personal data is necessary to provide you with the best possible service. We process your personal data for the following purposes.

Compliance with legal obligations

We process personal data to comply with legal obligations, such as data verification, administrative requirements or retention periods.

Marketing and business development purposes

In order to maintain and expand our customer base, we may contact you by e-mail or regular post with information, publications or invitations that are relevant to you. We also do this to maintain relationships with our partners, suppliers and other contacts. You can stop receiving newsletters and commercial communications by following the instructions provided in each message.

Use and improvement of our Products and website

In order to monitor, personalise and improve the content and use of our Products and website, we collect and analyse the use of our Products and the browsing behaviour of visitors to our website. Participation in our events

When you register for one of our events, we ask for your personal data. We use this to confirm your registration, keep you informed about the event in question, register your attendance and, if necessary, send you a certificate of participation.

On what grounds do we process personal data?

Personal data may only be processed if there is a legal basis for doing so. The processing described above takes place on the basis of one of the following legal bases included in the General Data Protection Regulation (GDPR).

  • for the performance of a contract;
  • with your consent;
  • due to a legal obligation; and
  • because of a legitimate interest.

Where do we process personal data?

Your data will only be processed within the European Union/European Economic Area (EU/EEA).

With whom do we share personal data?

Within MY-LEX

We share your personal data within the business units of MY-LEX.

Third parties

It may also be necessary for us to share your personal data with trusted third parties. This may include the following cases:

  • external suppliers that we engage for processing as described in this privacy statement, such as our IT suppliers;
  • third parties involved in hosting or organising our events;
  • third parties that we engage in the context of advertising, marketing and promotion to help us deliver and analyse effective advertising campaigns and promotions; and
  • web analytics tools that track the browsing behaviour of visitors to our website in order to monitor and improve the use of our website, such as Google Analytics.

Third parties to whom we provide your personal data are also responsible for the processing of that personal data and for compliance with the applicable laws and regulations. If a third party processes your personal data as a processor on behalf of MY-LEX, we will enter into a processing agreement in accordance with the requirements of the applicable laws and regulations.

Other situations

We may also share your personal data in the following situations:

  • as part of a sale of (part of) MY-LEX to another company;
  • to protect and defend the rights and property of MY-LEX; and
  • when required by law and regulations and/or government authorities.

How long do we retain personal data?

We do not retain your personal data longer than is necessary for the purpose for which we collected and recorded it. We retain your personal data for a maximum of two years from your last contact with us, unless a longer or shorter retention period is required by law or is necessary in connection with legal proceedings.

Security of your personal data

We make every effort to protect your personal data. To this end, we have taken appropriate technical and organisational measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification of your personal data. Our security measures are continuously improved in line with technological developments.

The Products and our website may contain links to external websites or software managed by other organisations. They may collect personal information from individuals who visit their website or use their software. MY-LEX cannot offer any guarantees regarding the privacy policies of these organisations and accepts no responsibility for them.

Your rights

You have the right to view your personal data upon written request. If the overview provided by us contains inaccuracies, you can request us in writing to change or delete the data. If you have any questions or would like to know what personal data we hold about you, please contact us. To do so, please use the contact details provided at the end of this privacy statement.

Under applicable data protection laws and regulations, you also have the following rights:

  • to receive an explanation of what personal data we hold about you and what we do with it;
  • access the exact personal data we hold about you;
  • to have errors corrected;
  • to have outdated personal data deleted;
  • withdraw consent; and
  • object to a particular use.

We will assess whether we can comply with your request on the basis of the law and regulations. It is possible that we will not be able to comply with your request. An example of this is a situation in which the processing of certain personal data is required in order to comply with legal obligations. If we are unable to comply with your request, we will always provide you with a reason for this.

Complaints

We are happy to help you if you have any complaints about our processing of your personal data. If you have a complaint, please contact us using the contact details provided at the end of this privacy statement. You also have the right to lodge a complaint directly with the Data Protection Authority about the way in which we process personal data.

Changes

MY-LEX may amend this privacy statement from time to time. The most current version of this privacy statement can be found on our website. We recommend that you check this page regularly so that you are aware of any changes. If this privacy statement is changed significantly, we will also publish a clear message on our website.
